Privacy Policy

Purpose of this Notice.

The purpose of this Privacy Policy (“Privacy Policy”) is to inform you of how The Collier Companies (“TCC”) and its family of companies, including its affiliates, subsidiaries, and other related entities operating apartment communities owned or managed by TCC (collectively, “The Collier Companies”), protect and use your personal information.  We are committed to respecting your privacy rights.  Please read this Privacy Policy carefully.  It gives you important information about how we handle your personal information.

This Privacy Policy covers information practices of websites that link to this Privacy Policy, including colliercompanies.com and any other domain owned by TCC.  Websites that do not link to this Privacy Policy are covered by other privacy policies even if such websites are operated by or for TCC.

This Privacy Policy has been developed with the recognition that applicable laws regarding privacy and personally identifying information, and the dissemination thereof, are evolving.  Accordingly, this Privacy Policy is subject to change at any time and TCC expressly reserves the right to modify the terms of this Privacy Policy at any time and in our reasonable discretion.  Your continued use of any Sites that links to this Privacy Policy following our posting of a change notice will constitute binding acceptance of this Privacy Policy and all changes thereto.

Compliance with the Law.

We protect your privacy in accordance with the requirements of applicable state and federal laws and this Privacy Policy.  We will take commercially reasonable measures to ensure that the personal information you submit to us remains secure and is used and shared only for the purposes as set forth herein.  This Privacy Policy provides you with a notice of our privacy policies and practices informing you of the types of information that we collect from you and the persons or entities to whom your personal information may be disclosed.

Personal Information and Other Information.

In the course of your use of the Sites, you may voluntarily share personal information about yourself with us in several ways.  You may provide personal information to us on applications or other forms when communicating or transacting with us in writing, electronically, or by phone, and through requests for forms or literature in connection with your renting a Collier Company apartment.  This personal information may include, but is not limited to, your name, address, telephone number, e-mail address, social security number, driver’s license number, bank account information, gender, marital status, employment history, income, assets, credit score, credit history, lines of credit information, property you currently own or rent, the size of your household, and date of birth (collectively, “Personal Information”). If you register to use certain services available through the Sites using login credentials from an account you have with a third-party, such as a Facebook or Google account, you give us express permission to receive certain Personal Information from such third party, which may include (but is not limited to) your name, address, telephone number, and e-mail address.

When you visit the Sites, we also collect technical and usage information that does not identify you personally (“Other Information”), including information about your computer and Internet connection such as the IP address of your computer and/or Internet service provider, the date and time you access the Sites, the Internet address of websites from which you linked to our Sites, the type of device, browser and operating system you are using, and your movements and preferences on our Sites.

Use of Personal Information.

We may use your Personal Information in connection with certain aspects of our business.  For example, we may use Personal Information to contact you in response to your inquiries, comments and suggestions; to contact you otherwise when we deem appropriate; for the specific purpose for which it was volunteered (for example, to receive pricing quotes, surveys, blog updates, etc.); to track our visitors’ use of the Sites for internal market research; to improve the Sites and the services we promote or provide through the Sites or through other means; to customize the content and/or layout of our Sites for each individual visitor; to ask for your participation in brief surveys; to complete any purchases or other transactions you may perform through the Sites; to notify visitors about updates to the Sites or services; to notify you about promotions, special offers, etc., regarding products and services provided by TCC; as required by law or regulation, or as requested by government authorities; for our internal business purposes or to otherwise manage your relationship with TCC.

You may choose to opt out of receiving future marketing or promotional email messages from us.  Each such email (excluding non-promotional communications, such as those responding to your specific inquiries or related to your rental with us) sent by us contains an “unsubscribe,” “opt- out”, or similar link with instructions on how to remove yourself from the applicable email list.  Please note that if you are a current resident of one of our communities, and you opt out of receiving marketing or promotional emails from us, you will continue to receive emails from us regarding operational issues surrounding your apartment, your lease, and/or your community. Additionally, we may always email you in response to your correspondence or in connection with any other transactions you have with us.

We may use Other Information, which does not identify you personally, for any reason we deem appropriate, including for purposes of administering, protecting and improving our Sites and systems, to better understand the preferences of our Site visitors, to identify server problems, to compile aggregated statistics about Site usage, and to help personalize your experience on our Sites. We and our service providers may use the IP address of your device to approximate your general physical location such as city and state for purposes such as providing information on local promotions and events.

Sharing Personal Information.

We do not sell your Personal Information to third parties or disclose your Personal Information to third parties for their marketing purposes, except as set forth herein.

We may share Personal Information: to other companies within the TCC group to better serve your needs; to our service providers (such as our customer support specialists, survey and other email campaign providers, payment processors, cable provider, etc.), who are only permitted to use the information to provide services to us and you; as required by law or legal proceeding or to protect our or others’ legal rights; and in connection with an acquisition, merger, sale, or other transfer of all or any portion of our business. Additionally, we may share Personal Information with optional service providers that may be of interest to you as a resident of a TCC property, such as renter’s insurance providers and concierge, or other service providers.

We may share Other Information (which does not identify you personally) with any party for any purpose we deem appropriate.

Cookies.

In order to personalize and enhance your experience on our Sites, we also may collect information through “cookies.”  Cookies are small strings of text sent by our Sites to your browser and then stored by your browser on your computer’s hard drive.  Our cookies allow us to not only personalize your experience on our Sites, make your visit more convenient, and understand how you and others are using our Sites so we can improve your experience on the Sites.  We use cookies to identify repeat visitors to our Sites and to determine the paths visitors take on our Sites.  We also use cookies to determine whether you visited our Sites from a particular Internet link or advertisement.  Most Web browsers automatically accept cookies, but it is possible to change your browser setup, so it does not accept cookies.  However, not utilizing cookies may prevent you from using certain functions and features of the Sites.

Certain of our service providers (Google, Bing, and Facebook) use retargeting cookies to collect Other Information about you (including the pages and content you view, the date and time of such views, and location information associated with your IP address). These retargeting cookies allow us to serve you more relevant advertisements. To opt-out or otherwise adjust settings related to these retargeting services and cookies, users can visit Google, Bing, and Facebook.

Through cookies we place on your browser or device, we may collect information about your online activity after you leave our Sites.  Just like any other usage information we collect, this information allows us to improve the Sites and customize your online experience, and otherwise as described in this Privacy Policy.  Your browser may offer you a “Do Not Track” option, but our services do not support Do Not Track requests at this time, which means our cookies may collect information about your online activity while you are using the Sites.

Third Party Analytics Services.

We may use third party analytics services. Currently, we use the analytics services of Google Analytics and Entrata.

We use Google Analytics to better understand the behavior of visitors to our websites. This includes, but is not limited to, age, gender, location information associated with your IP address, pages viewed on the Sites, length of time on the Sites, browser used to access the sites, and device used to access the Sites. We use the Entrata platform as our property management software, and thus store and process Personal Information shared with us by prospective renters and residents of TCC properties through that platform to run analytics and conduct our operations. California Residents.

California law entitles California residents to certain additional protections regarding Personal Information. The contents of this section apply only to California residents and the Personal Information regarding them. For purposes of this section alone, “Personal Information” means any information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular California resident or household.

California residents have the right to request:

  • information regarding their Personal Information we have collected (the categories of Personal Information we have collected, the source of such information, and how we have used such information);
  • a description of whether we have disclosed their Personal Information to third parties, and if so what categories of information we have disclosed, and what categories of third parties we have disclosed it to);
  • a copy of their Personal Information collected by us in the past 12 months;
  • that their Personal Information be deleted; and
  • that their Personal Information not be sold to third parties.

We may require verification of your identity before further processing your request and may use a third-party identity verification business partner to complete such verification. In certain instances, we may be permitted by law to decline some or all of such request. Please note that we need to keep certain information to complete transactions, detect security incidents, prevent fraudulent or illegal activities, identify and repair errors, comply with laws and regulations, and for other solely internal and lawful purposes.

Confidentiality.

We treat Personal Information as confidential and recognize the importance of protecting access to it.  We restrict access to Personal Information about you to only those employees who need to know that information to provide products or services to you.  We maintain commercially reasonable physical, electronic, and procedural safeguards to guard your Personal Information.  While our security measures are intended to protect your Personal Information, the complete security of any transmission over the public internet cannot be guaranteed.

Third Party Websites.

This Privacy Policy does not govern, and we are not responsible for, the privacy, information security, or other practices of any third parties, including any third party operating any site or service to which the Sites link. The inclusion of a link on the Website does not imply our endorsement of the linked site or service.

Children’s Data.

The Sites are not directed at or intended to be used by children, and TCC will not intentionally collect or maintain Personal Information about anyone under the age of 13, except for information provided by the relevant parent(s) or guardian(s). If we discover that we have collected any other Personal Information about anyone under the age of 13, we will take reasonable steps to promptly delete such information from our systems.

Consent.

By using this Site, you consent to our collection, use, and disclosure of Personal Information as described herein.  We reserve the right, at our discretion, to change, modify, add, or remove portions of this Privacy Policy from time to time.  The amended Privacy Policy will be effective upon posting on the Site.  Your continued use of the Sites and/or services means you agree to the revised Privacy Policy and our use of your Personal Information in accordance with the revised policy.  We may, but are under no legal obligation to, provide you notice of such modifications to this Privacy Policy via email, text or other communication.  Your provision of Personal Information through the Sites constitutes your affirmative consent that we may contact you by email to provide you with information and notices relating to the property where you reside, and various services available to you at or through that property.
